Gerald of TriviaTerms of Service

These terms govern your use of Gerald of Trivia (“Gerald,” “we,” “us”), a trivia bot for Discord and this website. By adding Gerald to a server or playing with it, you agree to these terms. If you do not agree, please do not use Gerald.
1. What Gerald is
Gerald runs trivia races inside Discord servers — posing questions, judging answers, keeping score, and producing leaderboards and other features. Gerald is currently in private beta, provided free of charge, and funded out of pocket.
2. Eligibility
You must comply with Discord’s Terms of Service and meet Discord’s minimum age requirement to use Gerald. To add Gerald to a server, you must have the necessary permissions on that server.
3. Acceptable use
When using Gerald, you agree not to:
- Abuse, overload, disrupt, or attempt to interfere with Gerald or the systems it runs on.
- Attempt to gain unauthorized access to Gerald, its data, or other users’ data.
- Exploit bugs to cheat, manipulate scores, or gain an unfair advantage.
- Use Gerald for anything unlawful, or in violation of Discord’s rules.
We may limit, suspend, or remove access to Gerald — for a user or a whole server — if we believe these terms are being violated.
4. Support & tips
Gerald is free to play. You may optionally support Gerald with a tip through Ko-fi. Tips are voluntary, non-refundable, and unlock no features, content, or advantages — they simply help cover hosting and upkeep. If paid plans are introduced in the future, they will be governed by terms presented at that time.
5. Availability & changes
Gerald is a beta product offered on an as-available basis. We may add, change, suspend, or discontinue any part of Gerald — or Gerald as a whole — at any time, without notice or liability. We do not guarantee uninterrupted or error-free operation.
6. Intellectual property
Gerald — its name, artwork, the software behind it, and all of its trivia content — is owned by us. Every question in play has been written or rewritten by us. These terms do not grant you any right to copy, resell, reverse-engineer, or redistribute Gerald or its content, except as allowed by Discord’s platform or by applicable law.
7. Disclaimer of warranties
Gerald is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. You use Gerald at your own risk.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of Gerald. Because Gerald is provided free of charge, our total liability for any claim relating to Gerald is limited to the amount you paid us for it in the twelve months before the claim — which for a free product is zero.
9. Privacy
Your use of Gerald is also governed by our Privacy Policy, which explains what data we collect and how we use it.
10. Governing law
These terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-law rules.
11. Changes to these terms
We may update these terms as Gerald evolves. When we do, we will revise the “Last updated” date above. Continued use of Gerald after a change means you accept the updated terms.
